Persons with criminal records can be denied housing based on their criminal record. However, housing providers should be reviewing only convictions not charges, and should ensure their policies related to households with criminal records are not impacting adversely specific protected class members. Requests for accommodataions for persons with disabilities may be sought if the conviction is a result of, for example, a disability that was undiagnosed and untreated at the time of the offense. In addition, housing providers are encouraged to review documentation the household may provide that supports the unlikely event that an offense would re-occur.
